<title>Robbery Suspect Cleared By Facebook Alibi</title>

<htmltext>postermmxvicom writes <i>"Rodney Bradford has been cleared of robbery charges <a href="http://www.msnbc.msn.com/id/33883605/ns/technology\_and\_science-tech\_and\_gadgets/">because of a Facebook update</a>. The defense was able to prove that the update was made from his father's house, 13 miles away from the crime committed one minute earlier. Lawyer John G. Browning said, 'This is the first case that I&rsquo;m aware of in which a Facebook update has been used as alibi evidence. We are going to see more of that because of how prevalent social networking has become.' Surely, this must be media hype, since it would not be a difficult alibi to fake."</i></htmltext>

A low-tech possibility: <b>give a friend</b> access to your FB account and have them make the updates for you from a computer you normally use.
</p><p>
They would take one look at the CURL User-Agent field from the HTTP request from Facebook's HTTP Access\_log and know that you faked it.
</p><p>
They're likely to require your hard drive to verify the alibi, and i'm sure your bash history will be inspected.
</p><p>
The more technically savvy you are, the more likely they are to believe you could have faked or automated the update.
</p><p>
You're better off with an alibi that requires you to have answered a captcha to prove your whereabouts.
</p><p>
Typing an e-mail is good, if info is in it that could have not been known prior to the killing.
</p><p>
Participating in a chat room discussion with other people might be a sturdier alibi.
</p><p>
Posting on slashdot, if your post adds significant info, and it's clearly a reply to a post that was made by someone else.
</p><p>
Maybe someone could make a web-based service called <b>myalibi.com</b> or something, that would continuously ask the user to answer captchas and submit biometric data to prove that they are there.
</p><p>
Be useful for people afraid of being falsely accused of a crime.
</p><p>
They ship you an appliance, such as a mouse with a fingerprint reader. While you are using the computer they are generating a continuous stream of data that proves your location.

<br>
The article doesn't say, but what if this was a crime of opportunity? What if the evidence at the scene and witness's testimonies painted a motive that indicated it was a crime of opportunity, and not a pre-planned crime? If that was a case, then accepting a Facebook posting made at the time of the crime seems pretty reasonable. Maybe he called his father just after the crime, but one minute after an unplanned crime? That feels unlikely to me, too. And anyways, the court had testimonies and other evidence hinting that he wasn't the guy, so I don't think this will set a precedent that Facebook postings should be accepted without question in court.</htmltext>
